R v Sadique and Hussain (No.2) [2013] EWCA Crim 1120

Facts: D1 (Defendant 1) and D2 (Defendant 2) supplied chemicals that could be used to produce either Class A or Class B drugs. They were charged under section 46 of the Serious Crime Act 2007.

Held: Appeal dismissed. Conviction was upheld. The court ruled that the offence could be committed whether the chemicals were intended for Class A or Class B drugs, defining the scope of section 46.

Key Judicial Statement: Lord Justice Hughes stated, "The defendant must have an intention to assist in the commission of an offence, but it is not necessary to specify the exact offence as long as the intention to assist in a drug-related crime is present."
