R v Hawkesley [1959] 1 QB 467

Court: Court of Appeal (Criminal Division)

Facts: D drove P1 and P2 to a golf club where they intended to commit burglary. Although D knew of the plan by the time he dropped them off, he had not initially agreed to the conspiracy.

Held: The conviction was quashed. The court found that there was no agreement to commit the crime at the time D drove the conspirators. Actual agreement between parties is necessary.

Key Judicial Statement: Lord Justice Parker remarked, "For a conspiracy conviction, an agreement to commit the offence must exist from the outset, and mere knowledge of the plan without participation in the agreement does not suffice."
