Facts: The case addressed whether jurisdictional organs must themselves comply with Article 6(1) or if control by a judicial body with full jurisdiction was sufficient.

Held: The Court held that either jurisdictional organs must comply with Article 6(1) directly, or there must be effective control by a judicial body providing the guarantees of Article 6(1).

Judicial Statement: The Court noted, “Jurisdictional organs must either ensure compliance with Article 6(1) themselves or be subject to control by a judicial body that provides the necessary guarantees.”
