Facts: An undercover police officer, D2 (Defendant 2) , arranged with D1 (Defendant 1) for drug trafficking but missed the arrest. D1 was convicted of conspiracy.

Held: Appeal Dismissed. Conviction upheld. The court found that D1's intent at the time of agreement was sufficient, regardless of D2’s motives or subsequent actions.

Key Judicial Statement: Lord Hutton remarked, "The defendant's intention at the time of agreement to commit the crime is sufficient; motives or subsequent failures do not affect this intent."
