R v Tosti [1997] 2 Cr App R 427

Court: Court of Appeal (Criminal Division)

Facts: D and others examined a barn's padlock and were found with burglary tools but were interrupted before they could complete the burglary. There was sufficient evidence to connect D with the equipment

Held: Conviction upheld. The court found that examining the padlock and having burglary tools were sufficient for an attempt.

Key Judicial Statement: Lord Justice Stuart-Smith observed, "Actions that clearly demonstrate preparation and readiness to commit a burglary can constitute an attempt, even if the crime was not completed."
