Facts: D was convicted of manslaughter for injecting V with insulin in contravention of the Medicines Act.

Held: The Court of Appeal refused to admit the fresh evidence. Conviction for manslaughter was upheld. The unlawful act of administering insulin in breach of the Medicines Act was deemed dangerous.

Key Judicial Statement: Lord Justice Kay stated, "The unlawful act must be dangerous in the context of the circumstances, and the jury must determine if the act was dangerous as perceived by a reasonable person."
